Snow Removal Policy Violations
The
Pla-Vada Community Association duly adopted Fine Policy
is as follows:
As
per the Pla-Vada Community Association rules, no one is
allowed to snow plow any sub-division roads without permission
from the Board of Directors.
- First Offense - $500
- Subsequent violations - $500 per each day
Other
violations of CC& R’s, Bylaws, Resolutions and
Policies
- First Offense - "Good Neighbor” letter
sent to Member
- Second Offense - $100
- Subsequent violations - $150 per day, for each
day on which a violation exist
First offense fines
are subject to the member’s right to a Notice and
Hearing as determined by the association's governing documents
and California Civil Code Section 1363(h). Second and
subsequent fines will be imposed immediately and will
be imposed on a daily basis for each day the violation
exists.
Non-payment of fines
will result in suspension of membership rights. Subsequent
litigation will be handled by legal counsel and recovery
of costs incurred by the Association will be sought from
the offending member.
